These Terms of Service (“Terms”) govern your access to and use of FindNext Corp. websites, communities, and current or future Services.

1. Acceptance of Terms

TrendGuard™ is operated by FindNext Corp (“FindNext,” “we,” “us”). By accessing our website, participating in our community or early access programs, or using any current or future TrendGuard services (collectively, “Services”), you agree to these Terms and our Privacy Policy.

Some Services are in beta or development and may change. Certain provisions take effect upon general availability.

2. Services & Beta Programs

2.1 Scope

Our Services include the website, community activities, early access/beta features, and planned trust infrastructure (e.g., authenticity verification, agent trust APIs, fraud detection).

Where provided, AI or software agent outputs are probabilistic and may be incomplete or inaccurate. You are responsible for evaluating outputs and complying with applicable laws and platform rules.

Use Services for lawful, legitimate purposes and in accordance with these Terms.

5. Feedback & Ownership

If you submit ideas, suggestions, or feedback (“Feedback”), you grant FindNext a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate the Feedback without restriction or compensation. You retain ownership of your content; we retain ownership of the Services and derivative works.

6. Privacy & Data

Our Privacy Policy explains how we collect and use personal data and includes a Cookies & Tracking section and consent tools. For enterprise relationships, a separate Data Processing Addendum (DPA) may apply.

7. Service Limitations & Third-Party Services

Accuracy & Reliance

TrendGuard is assistive infrastructure. You remain responsible for decisions and compliance, including authenticity determinations and fraud controls.

8. Intellectual Property

FindNext owns the Services and all related IP, including software, models, designs, trademarks (e.g., “TrendGuard”), and documentation. No rights are granted except as expressly stated.

8.1 Limited License

Subject to these Terms, we grant a limited, revocable, non-transferable, non-sublicensable license to access and use public portions of the Services.

8.2 DMCA & Notices

If you believe content infringes your copyright or trademark, contact legal@findnextcorp.com with sufficient detail for us to review.

9. Disclaimers

AS-IS / AS-AVAILABLE

To the fullest extent permitted by law, the Services (including beta/early access and any agent/API outputs) are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.

10. Limitation of Liability

CAP & EXCLUSIONS

To the fullest extent permitted by law, FindNext will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our aggregate liability for all claims arising out of or related to the Services shall not exceed the greater of (a) amounts you paid to us for the Services in the 12 months prior to the event giving rise to the claim, or (b) USD $100 if no amounts were paid.

11. Indemnity

You will indemnify and hold harmless FindNext and its affiliates, officers, directors, employees, and agents from and against any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, violation of these Terms, or infringement of any third-party rights.

12. Termination

You may stop using the Services at any time. We may suspend or terminate access for any violation of these Terms, risk to the Services or users, or for legitimate business reasons. Upon termination, all licenses end, and sections that by their nature should survive will survive (including 5, 7–14).

13. Dispute Terms

13.1 Informal Resolution

Contact legal@findnextcorp.com to attempt informal resolution before filing a claim.

13.2 Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-laws rules. Exclusive jurisdiction and venue lie in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

13.3 Class Action Waiver; Jury Trial Waiver

To the extent permitted by law, disputes must be brought on an individual basis and not as a class action. YOU AND FINDNEXT WAIVE ANY RIGHT TO A JURY TRIAL.
